1. Seller and scope
These terms govern consumer sales made by MGCODB, French simplified joint-stock company (SAS), with share capital of 1 000,00 €, registered office 695 Route de Bigary, 26790 Suze-la-Rousse, France, SIREN937 960 144, SIRET937 960 144 00015, registered with 937 960 144 R.C.S. Romans, EU VAT number FR72937960144, trading as La Truffe Française and presenting wines under the brand Domaine Les Hermessaines. Contact: leshermessaines@gmail.com.
The wines ‘L’Automne’, ‘Résonance’ and ‘Le Trésor de Fripon’ are resold by MGCODB, which acts as the reseller and the customer's contractual seller.
The wines are produced and supplied by EARL DU GRAND BOIS, French limited-liability agricultural enterprise (EARL), based at 637 Route de Bigary, 26790 Suze-la-Rousse, France, SIREN387 981 228, SIRET387 981 228 00019.
MGCODB is the customer's point of contact for orders, payments, invoicing, withdrawals, returns, refunds, statutory warranties and after-sales service.
The shop delivers only to metropolitan France. Business sales and international shipments require separate terms and a quotation.
2. Products and availability
Essential characteristics, volume, alcohol content, allergens and prices including tax are shown before ordering. Offers are subject to available stock.
If a product becomes unavailable after ordering, the customer is informed promptly and refunded. Products with unapproved mandatory information cannot be ordered.
3. Legal age
Alcohol sales are prohibited to anyone under eighteen or below the legal age in their country of residence or delivery. Le client confirme sa majorité avant le paiement. Une preuve d’âge peut être demandée lors de la commande ou de la remise du colis.
4. Orders
Customers check their basket, delivery address, total price and shipping costs before confirming. Errors can be corrected before payment.
The final order is placed using a button that clearly states the obligation to pay and confirms acceptance of these terms. An order summary is then emailed on a durable medium.
5. Prices
€10 including tax per 75 cl bottle and €50 including tax per case of 6 bottles, excluding shipping.
Trade customers: preferential pricing and dedicated offers by quotation. Specify the wines, quantities and delivery location required.
Prices are in euros including all taxes. The price per litre and shipping charges are shown before confirmation. The applicable price is the price displayed when ordering.
No additional charge may be made unless disclosed before the customer commits to the order.
6. Secure payment
Card payments are processed by Stripe through a secure interface on behalf of seller MGCODB. MGCODB neither receives nor stores the full card number. Orders are prepared only after payment is confirmed.
If payment is declined or fails, no order is concluded.
7. Preparation and delivery
Preparation time and the delivery date or timeframe are stated in the proposal before any commitment. Dispatch takes place after the order and payment are confirmed.
Delivery costs depend on your destination and the number of bottles. MGCODB confirms the carrier, total cost and delivery time before any commitment. No flat delivery fee has been set yet.
Collect at the cellar by appointment, with no shipping charge. Wait for confirmation that your wines are ready and your collection time is agreed before travelling.

Delivery is provided by an independent carrier. MGCODB remains responsible to the consumer until physical handover of the parcel, without prejudice to its recourse against the carrier.
In the event of delay, customers have the rights provided by the French Consumer Code, including requesting delivery within a reasonable additional period and, if this fails, terminating the contract.
8. Damaged parcels, breakage or errors
Customers are encouraged to inspect the parcel on delivery and photograph any breakage, leakage or other issue. They may note specific concerns with the carrier and contact MGCODB promptly. Failing to record reservations does not remove statutory warranties.
After checking the issue, MGCODB arranges replacement, reshipment or reimbursement as appropriate.
9. Right of withdrawal
Consumers have fourteen days from receipt to notify withdrawal without giving a reason, using the withdrawal page or an unambiguous notice sent to leshermessaines@gmail.com.
Products must be returned in suitable packaging within fourteen days after notification. Customers bear direct return costs. MGCODB refunds amounts received, including standard delivery, within the statutory deadlines and may withhold reimbursement until the goods or proof of dispatch are received.
Customers may be liable for handling beyond what is necessary to establish the product’s nature and characteristics. An opened bottle may incur a deduction reflecting its diminished value.
10. Statutory warranties
Consumers benefit from the statutory conformity warranty under Articles L.217-3 et seq. of the French Consumer Code and the latent defects warranty under Articles 1641 et seq. of the French Civil Code.
Claims may be sent to MGCODB with the order number, a description of the defect and, where possible, photographs.
11. Personal data
Data required for an order is processed to perform the contract and meet legal obligations. Stripe, the email provider and the carrier receive only the data needed for their tasks. See our privacy policy.
12. Mediation and disputes
Sales will remain closed until MGCODB has joined an approved consumer mediation service and completed its formalities for takeaway alcohol sales. Required information will be published before any orders are accepted.
French law applies, subject to mandatory provisions offering consumers greater protection. If an amicable agreement or mediation fails, disputes fall under the courts competent under applicable law.
13. Images and intellectual property
Illustrative images. Contractual product characteristics remain applicable. Reproduction or reuse requires permission.
